The Appeals Committee has responded to an appeal on this disciplinary action:

On 16 May 2021, SMJHL adjusted their simmer punishments for minor simulation infractions. The first minor infraction in a season was penalized by a $1m fine, and further minor infractions in the same season by a $2m fine. The scale was codified in the SMJHL rulebook as section 9.L. During the S63 playoffs, Air Crou and Pythonic both committed minor sim infractions. For both players, it was their first offense of the season.

When discussing Air Crou’s and Pythonic’s playoff infractions, SMJHL Head Office believed that the current penalty for sim infractions was too low. They increased the structure for infractions during the playoffs when announcing the penalty. SMJHL Head office applied the new penalty structure to both Air Crou and Pythonic, charging a $2m fine to both users.

We believe it is important that the rulebook, while it is constantly evolving and changing to meet the league’s needs, should at any isolated moment in time be a stable reference for the league’s rules and policies. While Head Office has some latitude when emergent issues are identified and when the rulebook does not explicitly define terms for a penalty, the letter of the law should reliably be applied as written at the time of an infraction where possible. In this case, the rule and the penalty were explicitly written at the time of the infraction.

The Appeals Committee has voted to reduce the fines for both Air Crou and Pythonic to $1m for these infractions. It is the opinion of the committee that this specific offense should be penalized under the previous scale, but it still counts as a “strike” in the new scale if either user commits another infraction during the current playoffs.

I understand and support the Appeals Committee's decision. However, some minor points to note just for transparency and clarity. Section 9.L did not exist until today, and HO felt sim infractions specifically during playoffs were too low. Other than that, thank you for the quick decision Appeals Committee

understood--we made an incorrect assumption that the policy was written in the rulebook. that said, we know the policy was announced and codified in a 16 May 2021 announcement post and was the operating policy of the league. our decision doesn't change and our position doesn't change dramatically, just the phrasing

3 mistakes in a single post season is as incompetent as you can get. If simmers aren't able to sim for any reason, they simply need to let HO and the rest of the sim team know before the sim (or provide a valid excuse after the fact) and they won't face punishment.

This 3 strike system, that resets every post season, is pretty damn fair in my eyes.
